AI agent training for collections agents in consumer lending in Spain

Training Spanish consumer lending collectors to oversee AI agents: EU AI Act literacy, AEPD limits on third-party contact, held actions and a 90-day plan.

Spanish consumer lenders should train collections agents to review an AI agent's drafts and held actions, to keep third-party contact, default file entries and forbearance decisions with people, and to meet the EU AI Act's literacy duty. The plan below certifies a desk in 90 days, built around Spain's data protection pressure points.

What does a collections agent at a Spanish consumer lender actually do?

The desk works point-of-sale finance, credit cards, revolving credit and personal loans. A collector's day is calls and messages to customers in early arrears, payment plans for those who cannot clear the balance, and the paperwork that follows: confirming what was agreed, updating the account and recording consent where the customer chose a new channel.

Two decisions carry most of the risk. The first is whether to include a customer in a shared credit default file, which requires a debt that is certain and due, and a prior demand for payment that warned of inclusion. The second is whether to sell or pass the debt on. Spanish collectors also work across languages: a customer in Barcelona or Bilbao may prefer Catalan or Basque, and a reminder that ignores that preference reads badly.

Where can an AI agent take work off the desk, and at what depth?

Account briefing, depth 1. Before contact the agent reads balances, missed payments, previous agreements, channel preferences and any open complaint, and summarises them for the collector.

Reminders and payment plan proposals, depth 2. The agent drafts the message and a plan that fits the lender's affordability rules. A person sends it. Under Article 50 of the EU AI Act, a customer who chats with the agent directly must be told it is an AI system.

Agreed payment dates and receipts, depth 3. Once a customer confirms a date the lender's rules allow, the agent records it and sends the confirmation. When the payment lands in the core ledger, the agent closes the promise.

Default file inclusion and debt sale, held. The agent assembles the evidence, including proof that the prior demand was sent and received, and holds the action for a named person. A missing proof of delivery should turn the verdict into a refusal.

What do collectors need to learn, and what do they keep?

The most useful skills for this desk are reading verdicts, checking provenance and correcting the agent so the correction lasts. Which AI agent skills matter most for collections agents ranks them; the full role map is in AI agent skills by role. For this market, add one: knowing which facts the agent must never use. A customer's family member who answers the phone is not a channel for the debt, whatever the agent's notes say.

Collectors keep the decisions that need human judgement or carry legal effect. They decide on forbearance when a customer explains a change in circumstances. They decide whether the lender has met the conditions for a default file entry. They handle complaints, which in Spain often escalate to the Banco de España's complaints service. And they handle any conversation where the customer is distressed, ill or bereaved, even if the agent proposes a standard plan.

Which Spanish and EU rules shape oversight and literacy?

The Banco de España supervises lenders' conduct and expects fair treatment of customers in difficulty; significant banks also sit under ECB banking supervision. EU consumer credit rules expect lenders to show reasonable forbearance before starting enforcement, which makes the forbearance decision a trained person's job.

The EU AI Act applies directly. Article 4 requires providers and deployers to take measures so that staff using AI systems have sufficient AI literacy; for a collections desk that means people who know what the agent can and cannot do and how to overrule it. The sector detail is in EU AI Act Article 4 AI literacy for consumer lending. Article 14 sets human oversight expectations for high-risk systems, and Article 26 sets deployer duties. Annex III lists creditworthiness assessment of natural persons as high-risk, so a collections agent whose output feeds a new credit decision may be in scope.

GDPR applies throughout, and the AEPD enforces it actively in debt collection. Telling a relative, neighbour or employer about a debt is a data protection risk the AEPD takes seriously, and Article 22 limits decisions based solely on automated processing that significantly affect a person, such as a default file entry made without human review.

This is an explanation of the rules, not legal advice; confirm how they apply to you with counsel.

What does the 90-day training plan look like?

Weeks Who What Evidence
1 to 2 Whole desk and team leads Foundations: depth, verdicts, provenance, the record Completion per person, kept for the Article 4 file
3 to 6 Collectors Shadow review of held plans and default file proposals, compared with a team lead Disagreement log
7 to 10 Reviewers Reviewer training and two-week practicum on live held items Practicum result
11 to 13 Team leads Rota and approval rights tied to current certificates Rota and rights list

A rota keeps certified reviewers available across shifts and languages; building a reviewer rota for the lending team shows how to size it. Spread Catalan, Basque and Galician speakers across the rota so held messages in those languages never wait for one person.

Where the Academy fits

Pryme Intelligence Academy gives the whole desk the free Foundations track, which serves as the base layer of an Article 4 literacy record. Reviewers then take the Operator track, with module tests set in consumer lending and collections, and earn Certified Pryme Operator after a 40-question exam with a pass mark of 32 and a two-week practicum. The admin view shows who holds a current certificate.

Questions people ask

Must a customer be told they are talking to an AI agent?

Yes, when they interact with the AI system directly, under Article 50 of the EU AI Act. Build the disclosure into the agent's first message rather than leaving it to the collector.

Can an agent add a customer to a shared default file?

It should not do so on its own. It can prepare the case and check the conditions, but a person should confirm the debt and the prior demand before the entry is made.

Does Article 4 require a certificate?

No. It requires sufficient literacy for the people involved. A certificate is one way to show it; records of training and assessment are another.
