AI agents for operations leaders in consumer lending in France

How AI agents help French consumer lending operations with incident register checks, withdrawal periods and over-indebtedness under the EU AI Act.

Every French consumer loan must pass the national incident register check, respect the borrower's withdrawal period and stay under the legal maximum rate, and operations owns all three, plus files suspended by over-indebtedness procedures. AI agents can run checks, track deadlines and assemble files. Credit decisions stay human, partly because the EU AI Act treats creditworthiness assessment as high-risk.

What do consumer lending operations leaders in France spend their time on?

Pre-contract checks set the pace. Before granting credit, lenders must consult the national register of household repayment incidents kept by the central bank, assess the borrower's creditworthiness on sufficient information, and give pre-contract information in the required form. Missing a step can make interest forfeitable, so operations checks each file before funding.

Timing rules are the second load. Consumers have a statutory period to withdraw from a credit agreement, and funds generally cannot be released for an initial period after signature, with some exceptions where the consumer asks. Rates and costs must stay below the legal maximum rate, which is set periodically by product category. Every agreement must respect all three.

Third, over-indebtedness. When a household's case is accepted by the over-indebtedness procedure, lenders must suspend enforcement and respond to the commission with information about the debt. Operations also reports new repayment incidents to the register and removes them once regularised.

Where can AI agents help?

  • Register and pre-contract checks (depth 1). The agent confirms that the register was consulted at the right time, that the information form matches the offer, and that the creditworthiness file holds the required evidence. It lists gaps before funding.
  • Funding timing control (depth 3). The agent tracks each agreement's withdrawal period and the earliest permitted release date, and releases or holds disbursement instructions accordingly within limits. Requests for early release are held for a person to verify.
  • Maximum rate tests (depth 1). The agent recomputes the annual percentage rate including insurance and fees and compares it with the applicable maximum rate for the product category and period, flagging any agreement near or above it.
  • Over-indebtedness file assembly (depth 2). When notification arrives, the agent suspends collection actions, gathers the account history and drafts the response to the commission for a person to approve.

Funding timing illustrates why depth must match reversibility. Releasing funds early, against the borrower's withdrawal right, is hard to undo; holding them a day too long is a minor delay. Our article on irreversibility in lending explains how that asymmetry should shape every bound. The general method is in deploying AI agents: train, shadow, certify, widen.

What stays with people?

Creditworthiness assessments and credit decisions stay with people. Under the EU AI Act, AI used to evaluate creditworthiness or establish credit scores of natural persons is high-risk, with duties on human oversight, logging and transparency. Keeping the agent out of the decision keeps it out of that category, and keeps accountability where the borrower expects it.

Where a decision is based solely on automated processing and has significant effects, GDPR Article 22 gives the borrower rights to human intervention and to contest it. People also decide early-release requests, reporting to the incident register in disputed cases, and responses to the over-indebtedness commission.

Which rules apply in France?

The ACPR supervises lenders, including credit institutions and finance companies, for prudential matters, AML/CFT and conduct, with the ECB directly supervising significant banks and the EBA setting EU guidelines, including on loan origination and creditworthiness. French consumer credit law sets the register consultation, pre-contract information, withdrawal period, funding delay and maximum rate rules described above, implementing EU consumer credit rules.

GDPR, enforced by the CNIL, governs borrower data: Article 6 lawful basis, Article 22 rights on automated decisions, Article 35 impact assessments for high-risk processing such as credit scoring. DORA (Regulation (EU) 2022/2554), applying from 17 January 2025, covers ICT risk and third-party risk for financial entities, including the agent's supplier.

The EU AI Act (Regulation (EU) 2024/1689) entered into force on 1 August 2024 and phases in. Annex III lists creditworthiness assessment and credit scoring of natural persons as high-risk. Providers and deployers have different obligations, and Article 26 deployer duties apply to lenders using high-risk systems.

How do you start in the first 90 days?

Month one: choose maximum rate tests and pre-contract checks. Both read and flag, and both protect against forfeiture of interest. Map the agent's role so it stays outside creditworthiness decisions.

Month two: replay on a quarter of funded agreements, compare with your compliance team's findings and investigate every difference.

Month three: certify at depth 1, then shadow funding timing control before allowing it to release funds. Australian lending operations look quite different; see our brief on operations agents in Australian consumer lending. For UK comparisons, see FCA Consumer Duty and AI agents in lending.

Questions people ask

Does using an agent for pre-contract checks make it high-risk under the EU AI Act?

Checking that steps were followed is not the same as assessing creditworthiness. Keep the agent's role limited to verification and document that boundary.

Can the agent report incidents to the national register?

It can prepare reports for clear-cut incidents. Disputed cases, where the borrower contests the debt, go to a person.

What happens to collections when an over-indebtedness case starts?

The agent suspends them immediately, which is protective and reversible. Any later action depends on the procedure's outcome and a person's decision.
