Spanish insurance compliance officers need to oversee AI agents as a key function holder: confirming each agent's depth and certificate, reading the verdict record, and keeping findings, complaints rulings and supervisory contact with people. They must also apply the EU AI Act and GDPR, with a 90-day plan to get there.
What does a compliance officer at a Spanish insurer spend time on?
Under the EU prudential regime for insurers, compliance is one of the key functions a firm must have, with direct access to the board. The Spanish compliance officer maintains the compliance plan, checks policies against regulation, reports to the board and the national insurance supervisor, and assesses the impact of regulatory change.
The product mix shapes the detail. Bancassurance is a large channel, so much life and home insurance is sold by bank staff whose training and conduct the insurer must oversee. Private health insurance is widespread. Funeral insurance, held by many households for decades, brings particular questions about long-standing policyholders, premium increases with age and clear information to elderly customers. And every insurer must run a customer service department that handles complaints within set time limits, which compliance watches closely.
Which tasks can an AI agent take for compliance, and at what depth?
Complaint pattern analysis, depth 1. The agent reads complaint files and outcomes from the customer service department, groups them by product and channel, and flags emerging themes such as premium increases on long-held funeral policies.
Bancassurance file checks, depth 1. The agent reads sales files from bank partners, checks that required documents and needs assessments are present, and flags gaps. Partner files are signed by a named counterparty, not sealed by the insurer's own systems, and the officer should weigh them accordingly.
Compliance reports and policy drafts, depth 2. The agent drafts the annual compliance report and updates to internal policies from the firm's records and approved sources. A person edits and signs.
Regulatory change log, depth 3. Within set bounds, the agent records new regulatory publications in the change log and assigns them for assessment. It reads external sources, so its summaries are external facts until an officer confirms them.
Communications with the supervisor or the AEPD, held. Drafted, never sent without a named person's release.
What must compliance officers learn, and what stays with them?
What compliance officers should learn before working with AI agents covers the basics. On top of it, officers at Spanish insurers need to oversee the agents that underwriting, claims and bancassurance teams use: check each agent's certified depth and the depth each action needs, confirm its certificate is current (they lapse after 90 days), and trace any decision through the record to the bound that decided it. They should understand the difference between a refusal the insurer's own limits produced and a withheld action set at the platform floor. The broader comparison is in AI agent skills by role, and the general purpose of this kind of learning is covered in what compliance training is.
The things that never move to an agent are listed in what compliance officers should never let an AI agent do. In this setting they include:
- concluding that a breach occurred and deciding whether to report it
- judging whether a bank partner's sales practice is acceptable
- any communication with the national supervisor or the AEPD
- approving the depth an agent may hold in a customer-facing process
- the compliance function's report to the board
The officer's role as the real control, rather than a box to tick, is argued in why compliance officers are the real control.
Which Spanish and EU rules shape oversight and literacy?
The national insurance and pension funds supervisor, part of the economy ministry, supervises Spanish insurers; EIOPA sets supervisory convergence across the EU. EU insurance distribution rules require ongoing training for people who distribute insurance, including bank staff in bancassurance, so firms already hold training records for their channels.
The EU AI Act applies directly. Annex III lists risk assessment and pricing for life and health insurance as high-risk, which is relevant for Spain's large private health market. Deployers of those systems face Article 14 human oversight, Article 26 duties and an Article 27 fundamental rights impact assessment. Article 4 requires sufficient AI literacy for staff using AI systems, and Spain has created a national agency to supervise AI. The AEPD enforces GDPR and pays close attention to automated processing; Article 22 limits solely automated decisions with significant effects, and Article 35 requires impact assessments for high-risk processing. DORA applies to insurers' ICT risk, including AI agents.

What does a 90-day plan look like?
First month: shared vocabulary and the record
The compliance function, internal audit and the bancassurance oversight team complete the Foundations material. Each officer then traces three real decisions from an underwriting or claims agent through the record, naming the deciding bound.
Second month: monitoring with an agent
A complaints and bancassurance monitoring agent goes live at depth 1. Officers compare its flags with their own sampling and log every disagreement with a reason, so the agent's brief improves.
Third month: certification and the oversight register
Reviewers among the officers complete their certification, including a two-week practicum. The head of compliance then signs an oversight register listing each agent, its depth, its certificate expiry and the responsible officer. The training plan template for compliance officers turns this into individual plans.
Questions people ask
Does Article 4 reach bank staff selling our policies?
If they use the insurer's AI system on its behalf, the insurer should treat them as within the literacy duty. Add AI literacy to the distribution training you already provide.
Can an agent summarise new regulation for the change log?
Yes, at depth 3 within bounds, but its summary is external until an officer confirms it. Assessment of impact stays with a person.
Should funeral insurance get special attention?
Yes. Long-held policies and elderly customers make clear information and fair premium changes a priority, and complaint analysis should track them separately.
