Gestorías and labour advisory firms in Spain should train payroll administrators to check an agent's work against sector and provincial collective agreements, to approve held social security filings and payment files, and to keep final settlements and sick leave decisions with people. The EU AI Act's literacy duty, GDPR and the AEPD set the legal frame.
What does a payroll administrator at a Spanish advisory firm do?
The administrator looks after payroll for dozens of clients, from a bakery with five staff to a logistics company with a hundred. Each month they apply the correct collective agreement, which in Spain often depends on both the sector and the province, calculate salary components, income tax withholding and social security contributions, and file the contributions through the social security system's electronic channel.
Several Spanish features add work. Most agreements require extra payments during the year, which some clients prorate monthly and others pay in full. Employers advance sick leave benefits and recover part of them, which needs careful tracking. Terminations need a final settlement with accrued holiday and proportional extras. And employers must keep a daily record of working hours, which clients send in every format imaginable.
Where can agents help, and at what depth?
- Depth 1, read. The agent reads each client's working-hours record and checks overtime and night work against the applicable collective agreement, flagging anything outside its limits.
- Depth 2, draft. It drafts the final settlement for a leaver with each component shown, and the email asking the client for missing sick leave documents. An administrator checks and sends.
- Depth 3, execute within bounds. It processes monthly variable pay from a client's agreed template and applies the agreement's pay tables, inside limits the firm sets.
- Depth 4, held. Filing contributions with the social security system and releasing the payment file are held for a named administrator.
Administrators should read provenance on every input. The firm's payroll ledger is sealed. The published collective agreement in the firm's sources is signed. A client's statement that an employee moved to a higher professional group is declared until the paperwork arrives. An email from "the employee" with a new IBAN is external, and an external claim cannot authorise a payment.
What stays with the administrator, and why?
Interpretation stays with people: which collective agreement applies when a client's activity spans sectors, how to classify a worker, how to calculate a disputed final settlement, and how to treat a long sick leave. So do bank detail changes and any correction to a filing already made. These decisions carry liability for the firm and its clients.
That is the case made in why payroll administrators are the real control in an AI agent deployment. Written approval rights make it real; how to set an approver rule for the payroll team shows how to tie them to amount, action and training.
What must administrators learn?
Every administrator at the firm should learn the vocabulary in AI agent skills by role, and the order in what payroll administrators should learn before working with AI agents works well for an advisory firm. Spain's patchwork of sector and provincial agreements then calls for three further skills.
First, reviewing a final settlement or a held filing systematically, as described in how payroll administrators review an AI agent's decisions: read the verdict, check which bound decided, confirm each component. Second, maintaining collective agreement sources by sector and province so the agent applies the right tables. Third, knowing that an agent's certificate lapses after 90 days and that a run that clears no depth drops it to depth 1 the same day, so variable pay processing may queue for people at month end.
Which rules in Spain shape oversight and AI literacy?
A gestoría that uses an agent on client payrolls is a deployer under the EU AI Act. Its first duty is Article 4: measures so that the administrators working with the agent have AI literacy suited to the job. Article 26 adds that oversight must sit with people who have the competence, training and authority to exercise it, Article 14 describes what that oversight involves, and Article 50 applies if client employees put questions to the agent themselves.
GDPR governs employee data, and the AEPD is the Spanish supervisory authority. The advisory firm usually processes for its client, so contracts should set roles. Sick leave records are health data, which GDPR treats as special-category data. Article 35 data protection impact assessments, Article 30 records of processing and Article 22's limits on solely automated decisions with significant effects all bear on payroll. Spanish labour law also gives workers' representatives a right to be informed about algorithms that affect working conditions, which a client may need to consider. Banco de España matters only where a client is a regulated financial firm.
This is an explanation of the rules, not legal advice; confirm how they apply to you with counsel.
What does a 90-day plan look like?
- Days 1 to 30. The firm picks a group of clients under two or three well-understood collective agreements. Administrators learn the vocabulary and the red lines, and the agent checks those clients' working-hours records at depth 1 while administrators confirm or reject each flag.
- Days 31 to 60. The agent drafts final settlements and the requests for missing sick leave paperwork. A senior administrator checks every settlement component by component before it goes to the client.
- Days 61 to 90. Clients whose variable pay templates are stable move to depth 3 processing. The head of the labour department records each administrator's level in the competency matrix for the payroll team and decides who may approve social security filings.
Where the Academy fits
Clients of an advisory firm increasingly ask who checks their payroll. Pryme Intelligence Academy gives a clear answer: the free Foundations badge for every administrator, and Certified Pryme Operator for those who approve filings, earned through a written exam where the pass mark is 32 of 40 questions and a practicum of real review decisions. A client can verify either through VerifyDoc.ai.
Questions people ask
Can the agent choose the collective agreement for a new client?
No. Choosing the agreement is a legal judgement. Once a person records it in the client's sources, the agent applies it.
Do clients need to tell workers' representatives about the agent?
Possibly, where the agent's output affects working conditions. The client should take advice on its own position.
How do we stop late variable pay data breaking the run?
Set a cut-off in the client's rules. The agent can flag late data and hold it for an administrator to decide.
