Cash penalties on settlement fails arrive every month, and reconciling them is routine work for French capital markets operations, alongside withholding tax reclaims, fund orders and dividend options. AI agents can check penalties, extract data from tax forms and repair routine order errors within limits. People decide disputes and costs. ESMA, the ACPR and DORA apply.
What do capital markets operations leaders in France spend their time on?
Settlement discipline drives much of the work. EU rules impose daily cash penalties on failing settlement, charged to the failing party and paid to the receiving one. Each month brings a penalty statement to reconcile against the firm's own fails, with disputes to raise before the deadline and costs to allocate to clients or desks.
Tax is the second load. Clients holding foreign securities lose withholding tax that treaties allow them to reclaim, and French operations teams prepare reclaims for clients across Europe. Each needs residence certificates, beneficial ownership forms and dividend vouchers, much of it in paper or scanned form.
Third, funds. Paris is a large fund centre, and operations processes subscription and redemption orders, checks cut-off times, and manages corporate actions on French issuers, such as dividend options where shareholders choose cash or new shares.
Where can AI agents help?
- Penalty reconciliation (depth 2). The agent matches each penalty on the monthly statement to the firm's own fail records, recalculates where it can, and drafts disputes for penalties that do not match. A person approves disputes before submission.
- Tax reclaim extraction (depth 2). The agent reads residence certificates, ownership declarations and vouchers, extracts the fields each reclaim form needs, and drafts the form. Our playbook on extracting data from forms and documents with an AI agent covers how to check extraction quality.
- Fund order repair (depth 3). For orders rejected on routine errors, such as a missing account reference the client supplied before, the agent corrects and resubmits before cut-off within limits. Changes to amounts or accounts are held.
- Dividend option processing (depth 2). The agent tracks elections from clients, applies defaults where the client did not respond under the agreed terms, and drafts instructions for a person to release.
Penalty reconciliation shows how agents change the economics of a task. Disputing a small penalty was rarely worth a person's time; an agent can check every line, and people review only the disputes. The method for introducing it is set out in deploying AI agents: train, shadow, certify, widen.
What stays with people?
Decisions to dispute or accept penalties above a threshold, and how costs are allocated between the firm and clients, stay with people. These affect client relationships and the firm's own profit.
Tax reclaim submission stays with a person who can answer for it. A reclaim filed on incorrect information exposes the client and the firm, and tax authorities expect a responsible party.
Election instructions sent to the market, especially where a client's choice is unclear, stay human. So do incident classification and reporting under DORA, and responses to supervisors.
Which rules apply in France?
ESMA coordinates EU securities rules, including settlement discipline. The ACPR supervises banks and insurers, and the markets regulator supervises investment services, market infrastructure and asset managers. The ECB directly supervises significant banks, with the EBA setting EU-wide guidelines.
DORA (Regulation (EU) 2022/2554), applying from 17 January 2025, requires ICT risk management, incident reporting, resilience testing and ICT third-party risk management for banks, investment firms, asset managers and market infrastructure. An agent in settlement or fund order processing supports critical functions, and its supplier is an ICT third-party provider to be registered, assessed and monitored.
GDPR, enforced by the CNIL, applies to personal data in tax and client documents. The EU AI Act (Regulation (EU) 2024/1689) entered into force on 1 August 2024; operations agents are usually not high-risk, but Article 4 AI literacy applies to staff working with them, and Article 12-style record-keeping is good practice for any agent that acts.

How do you start in the first 90 days?
Month one: choose penalty reconciliation. The data is structured, the agent drafts rather than acts, and savings are measurable. Register the agent and its supplier in your DORA register.
Month two: replay the agent on past monthly statements. Compare its disputes with those your team raised, and check the penalties it would have disputed that your team let pass.
Month three: certify at depth 2 and run it on the live statement. Begin shadowing tax reclaim extraction on a single country's forms. Australia's capital markets operations face different priorities; see our brief on operations agents in Australian capital markets.
Where Pryme fits
In Pryme, the firm's own fail records are sealed and the penalty statement from the market infrastructure is signed, because a named infrastructure answers for it. Where they differ, the agent drafts a dispute citing both, and the verdict is held for a named person before submission.
Questions people ask
Can the agent submit penalty disputes itself?
It drafts them. A person approves before submission, because disputes affect relationships with counterparties and infrastructures.
What happens to the agent when a process changes?
It is re-certified for the new process or retired. Our guide on how to retire an AI agent covers revoking access and keeping records.
Can the agent read handwritten tax forms?
It may, but accuracy on handwriting varies. Certify it on your actual documents and route low-confidence extractions to a person.
